執法指引講座

The Enforcement Guidelines of the Trade Descriptions (Unfair Trade Practices) (Amendment) Ordinance 2012 went into effect on 19 July this year. The new provisions govern trade practices on misleading omission, aggressive commercial practices, bait advertising, bait and switch, as well as wrongly accepting payments.

To help members better understand the new law, a seminar was organised on 17 June, 2013. Ms. Manda Chan, Principal Assistant Secretary for Commerce & Economic Development, Commerce & Economic Development Bureau, Mr. C K Chan, Head of Trade Controls and Ms. Rose Mao, Senior Trade Controls Officer, Trade Descriptions Ordinance Special Planning Group of Customs & Excise Department, were invited to introduce the Enforcement Guidelines. The seminar was attended by almost 300 retail practitioners.

In l ight of members' overwhelming responses and their huge concerns about the law, another seminar was hosted with legal firm Clifford Chance on 26 July, 2013. Members were briefed on the new provisions with illustrative cas business operations. The seminar wa retail practitioners who joined the disc vigorously with the speakers.

《2012年商品說明（不良營商手法）（修訂）條例》於 2013年7月19日生效，擴大對商戶的規管，包括就貨品 及服務作出誤導性遺漏、具威嚇性的營業行為、餌誘式 廣告宣傳、先誘後轉銷售行為，以及不當地接受付款。

有見及此，協會於2013年6月17日舉行講座，邀請了特 區政府商務及經濟發展局首席助理秘書長陳詠雯女士， 香港海關貿易管制處處長陳志強先生，以及商品說明條 例特別籌劃組高級貿易管制主任毛慧敏女士蒞臨，講解 修訂條例的執法指引，以提高業界對修訂條例的認識， 使能盡早做好預備工作。講座共吸引接近300位零售從業 員參加。

有鑑於會員反應踴躍，而且對執法指引尚有不少疑慮， 協會就同一議題於7月26日，與高偉紳律師事務所合辦另
